 Welcome to the Golden Finish & Co. Terms and Conditions of Service Use Agreement. For purposes of this agreement, the terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of our Services. “Site” refers to the Company’s website, which can be accessed at www.goldenfinishandco.com “Service” refers to the Company’s mobile automotive detail services performed. 


PLEASE READ FULLY BEFORE BOOKING A SERVICE ONLINE OR OFFLINE. You must agree to the Term and Conditions in its entirety. By booking a service you are stating you’ve read and agreed to all terms. 

SERVICE TIMES

Our service times are only estimates. Every vehicle is different and may take more or less time to complete desired services. We try our best to be efficient while still providing excellent services.

PRICING

We have a minimum call-out charge for our mobile services, 85% of the time it is already included in pricing depending on location. 

A minimum 20% surcharge will be applied to all jobs that involve urine, vomit, blood, feces, or other hazardous materials.

Our prices are based on detail type, location, type of car and condition of the vehicle and is advertised as a FROM price.

Golden Finish & Co. reserves the right to charge each vehicle according to its condition, the type of vehicle and the customer location.

Golden Finish & Co. reserves the right to amend any price during the detailing should it differ from the original estimate. 

ONSITE SERVICE PERMISSIONS POLICY

We are able to bring our services to you as this is our goal but we request that you have a site such as your home or office and that you have permission to do our services at this site; we cannot work on vehicles parked on the streets as this is illegal in some cities and the safety of our team could be compromised.


ONLINE BOOKING AND RESERVATIONS

Making a reservation for a service on Golden Finish & Co.’s Online Booking System does not guarantee that a specified time or date will be reserved or booked. Golden Finish & Co. reserve the right to approve a booked date or time; There might be a slight chance that an appointment has been booked offline and our booking system does not reflect it therefore, we will send you a confirmation email or call you to approve your reservation. We reserve the right to alter or move a booking at our discretion which could fall in line with staffing levels, weather conditions, machinery or equipment failure, etc. 

OFFLINE BOOKING AND RESERVATIONS

24 HOUR CANCELATION / RESCHEDULE POLICY

Golden Finish & Co. has a 24 hour cancellation policy. If for any reason you are unable to hold your appointment, Golden Finish & Co. requires a 24-hour cancellation / rescheduling notice. Failure to provide 24 hours advance notice of cancellation will result in a minimum charge of $30 or 20% of the service cost whichever is higher, this also applies to same day appointments that are canceled. A 24-hour cancellation / rescheduling notice is required because we not only lose your business but the business of potential customers who could have booked an appointment during your appointment slot.

There is no cost to reschedule and can do so at any time prior to 24 hours. 


INCLEMENT WEATHER CANCELLATIONS

We can never exactly predict what the weather will be like; please remember every scheduled service appointment is weather permitting. If the weather is inclement during your scheduled appointment we will automatically reschedule your service for the next available appointment slot at no extra cost.

If it is below 32 degrees, it is actively snowing or raining, roads have not been plowed, we will reach out to reschedule. 

24 HOUR REFUND / FIX IT POLICY

We do not give refunds for any services provided. You have 24 hours to reach out if there is anything unsatisfactory or you feel part of your detail was incomplete. We are in the business of customer satisfaction and will return within 24 hours free or charge to correct any issues. 

If you have driven more than 10 miles, washed your vehicle again, or had others service it within 24 hours this offer is void. 

PERSONAL ITEMS

Please remove extra personal items/items of value prior to your appointment. We will take the utmost care of anything left inside your vehicle, and return it to where it was found. However, we cannot be held responsible for any personal items left behind.


CHILD SEATS

Due to child safety and liability, we can remove but WILL NOT re-install car seats under any circumstances. We ask that our clients remove car and booster seats prior to appointment. Should the car seat be left in the vehicle we will remove it for the detail and place it back in the seat. We will remind you again post detail that the car seat is NOT installed at all.

CUSTOMER NOT PRESENT WHEN COMPLETED

I release Golden Finish & Co. from any liability pertaining to my vehicle if I cannot be present when the service is completed.

LEAVING KEYS WHEN NOT PRESENT

I hereby agree and authorize Golden Finish & Co. to leave the keys with a specified person, area of my vehicle, or location if I cannot be present upon completion of services. Golden Finish & Co. shall not be held responsible for my vehicle if it gets stolen or for keys being locked in my vehicle as a result of leaving them inside.


PAST AND PRE-EXISTING DAMAGE

It is difficult to find pre-existing damages during the initial vehicle inspection, some vehicles tend to have interior components that are broken, scratched, worn out, faded, don’t work or become loose and cracked without the owner’s knowledge, therefore should a Golden Finish & Co. Tech find any items that are not working properly, worn, scratched, cracked, faded, or broken we will bring it to your attention. Golden Finish & Co. is not and cannot be held responsible for any pre-existing damages to your car.


ENGINE BAY CLEANING

I hereby agree that Golden Finish & Co. shall not be held liable for any problem that may arise if I request Golden Finish & Co. to clean or wipe down the engine and/or engine compartment.


WAIT TIME AFTER COMPLETION

I hereby agree that Golden Finish & Co. cannot wait more than 15 minutes after I have been notified of completion of services. I also release Golden Finish & Co. from any liability pertaining to my vehicle or belongings after they have turned in the keys or left the premises.

VEHICLE OPERATION 

I hereby authorize Golden Finish & Co. to operate the submitted vehicle for the purposes of delivery, service, accommodation for space, inspection or any other reasons deemed necessary at my risk.

INTERIOR DETAIL

I hereby authorize Golden Finish & Co. if my vehicle’s interior is being detailed or cleaned to use a chemical cleaning solution to clean the steering wheel, dash, console and door panels., and to shampoo my seats and/or carpet using the Extraction Method/Wet Method in the submitted vehicle for the purposes of cleaning/detailing the interior at my risk. I also release Golden Finish & Co. from any liability pertaining to my vehicle for anything that may arise as a result of this or any interior service.

EXTERIOR DETAIL

I hereby authorize Golden Finish & Co. if my vehicle’s exterior is being detailed or wash to use a chemical cleaning solution to wash the exterior, tires and wheels., and to apply compound, polish or wax or a combination of these by hand or machine applied in the submitted vehicle for the purposes of cleaning/detailing the exterior at my risk. I also release Golden Finish & Co. from any liability pertaining to my vehicle for anything that may arise as a result of this or any exterior service.

GLASS - WINDSHIELD & WINDOWS

I hereby authorize Golden Finish & Co. to wash my vehicle’s exterior. I understand that during summer or winter seasons the changes in temperature might cause my windshield or windows  to crack due to temperature changes when water is sprayed or applied. I release Golden Finish & Co. from any liability pertaining to my vehicle’s windows and windshield for anything that may arise as a result of this or any exterior service.

VEHICLE BATTERY

I hereby agree that Golden Finish & Co. will have my doors opened to clean the vehicle's interior & could cause my battery to drain; I release them from any liability the battery drain may cause.

OWNERSHIP

I hereby agree and certify that I am the registered owner of the vehicle submitted to Golden Finish & Co.,and/or have authority by the registered owner(s) to submit the vehicle to Golden Finish & Co.

PAINT CORRECTION: CUT, POLISH, SCRATCHES

Paint correction is the removal of defects in the paint surface of the vehicle. 

Some scratches may be too deep to remove completely or safely. We will always do our best to minimize them but at the risk of removing too much clear coat, we will always err on the side of caution. It is better to live with a scratch VS taking away too much clear coat. Once the clear coat is breached and removed, the vehicle panel will need to be repainted, a service we do not provide. 

The amount of labor needed is different for every vehicle. We will never quote you over the phone or online.

Dirt can hide swirl marks, scratches, dings, paint chips, fine lines and marks, should we find any exterior imperfections, we will make you aware, however Golden Finish & Co. will not be responsible for correcting these pre-existing paint imperfections if your service does not include it.

During the course of paint correction, other paint defects may become evident and we will not be responsible for these pre-existing paint imperfections; smaller scratches, swirls and other defects tend to hide and mask more serious and deeper scratches that will then be more easily seen after paint correction. We will not be held responsible should we find pre-existing paint imperfection during our normal course of detailing that you were not aware of.

BOOKING REGISTRATION; RULES FOR USER CONDUCT AND USE OF THE SERVICE

You need to be at least 16 years old to book and/or create an account through our booking CRM Fieldd. 

If you are a user who signs up for the Service, you can create a personalized account which includes a unique username and a password to access the Service and to receive messages from the Company. You agree to notify us immediately of any unauthorized use of your password and/or account. The Company will not be responsible for any liabilities, losses, or damages arising out of the unauthorized use of your member name, password and/or account.


BOOKING PORTAL USE RESTRICTIONS

Your permission to use the Site is conditioned upon the following use, posting and conduct restrictions: 

You agree that you will not under any circumstances:

·    access the Service for any reason other than your personal, non-commercial use solely as permitted by the normal functionality of the Service,

·    collect or harvest any personal data of any user of the Site or the Service 

·    use another user’s account without permission;

·    intentionally allow another user to access your account; 

·    provide false or inaccurate information when registering an account;

·    bypass any robot exclusion headers or other measures we take to restrict access to the Service, or use any software, technology, or device to scrape, spider, or crawl the Service or harvest or manipulate data; 

·    circumvent, disable or otherwise interfere with any security-related features of the Service or features that prevent or restrict use or copying of content, or enforce limitations on use of the Service or the content accessible via the Service.

INTELLECTUAL PROPERTY

You acknowledge and agree that we and our licensors retain ownership of all intellectual property rights of any kind related to the Service, including applicable copyrights, trademarks and other proprietary rights. Other product and company names that are mentioned on the Service may be trademarks of their respective owners. We reserve all rights that are not expressly granted to you under these Terms of Use.

USER CONSENT TO RECEIVE COMMUNICATIONS IN ELECTRONIC FORM

For contractual purposes, you: (a) consent to receive communications from us in an electronic form via the email address you have submitted; and (b) agree that all Terms of Use, agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.

We may also use your email address to send you other messages, including information about the Site or the Service and special offers. You may opt out of such email by changing your account settings, using the “Unsubscribe” link in the message, or by sending an email to Goldenfinishco@gmail.com

Opting out may prevent you from receiving messages regarding the Site, the Service or special offers.

LIMITATION OF DAMAGES AND LIABILITY; RELEASE

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Golden Finish & Co., ITS AFFILIATES, DIRECTORS, OR EMPLOYEES, OR ITS LICENSORS OR PARTNERS, BE LIABLE TO YOU FOR ANY LOSS OF PROFITS, USE,  OR DATA, OR FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY VEHICLE DAMAGES, HOWEVER ARISING, THAT RESULT FROM: (A) THE USE OF OUR SERVICES; (B) YOUR USE OR INABILITY TO USE THE SERVICE; (C) THE SERVICE GENERALLY OR THE SOFTWARE OR SYSTEMS THAT MAKE THE SERVICE AVAILABLE; OR (D) ANY OTHER INTERACTIONS WITH USE OR WITH ANY OTHER USER OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS LIMIT OR DO NOT PERMIT DISCLAIMERS OF LIABILITY, SO THIS PROVISION MAY NOT APPLY TO YOU.

We have been fortunate enough never to have utilized this release, but want all of our customers to be aware. We are in the business of helping, so any issues that arise we will try our utmost to resolve between us and the customer. 

MODIFICATION OF TERMS OF USE  -  Last updated: 02/11/2024 

We can amend this Terms and Conditions of Service Use Agreement at any time and will update these Terms in the event of any such amendments. It is your sole responsibility to check the Site from time to time to view any such changes in this agreement. Your continued use of the Site or the Service signifies your agreement to our revisions to these Terms and Conditions.

WARRANTY DISCLAIMER

THE SERVICE IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, REGARDING THE SERVICE INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, SECURITY, ACCURACY AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY OR REPRESENTATION THAT ACCESS TO OR OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS.  SOME JURISDICTIONS LIMIT OR DO NOT PERMIT DISCLAIMERS OF WARRANTY, SO THIS PROVISION MAY NOT APPLY TO YOU.


PRIVACY POLICY

The Company respects the privacy of its Service users. Please refer to the Company’s Privacy Policy which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the Service, you signify your agreement to the Privacy Policy as well as these Terms of Use.


GENERAL TERMS

If any part of this Terms of Use agreement is held or found to be invalid or unenforceable, that portion of the agreement will be construed as to be consistent with applicable law while the remaining portions of the agreement will remain in full force and effect. Any failure on our part to enforce any provision of this agreement will not be considered a waiver of our right to enforce such provision. Our rights under this agreement survive any transfer or termination of this agreement.

You agree that any cause of action related to or arising out of your relationship with the Company must commence within ONE year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

These Terms and Conditions and your use of the Site are governed by the federal laws of the United States of America and the laws of the State of Colorado, without regard to conflict of law provisions.

We may assign or delegate these Terms of Service and/or our Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without our prior written consent, and any unauthorized assignment or delegation by you is void.

YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITION FOR GOLDEN FINISH & CO. LLC, UNDERSTAND THE TERMS OF USE, AND WILL BE BOUND BY THESE TERMS AND CONDITIONS. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS OF USE TOGETHER WITH THE PRIVACY POLICY REPRESENT THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US AND THAT IT SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
